Gotham State Penitentiary is the Federal facility in Gotham City that holds and imprisons all convicted felons in the Gotham City area. In addition to its regular criminal population, it also holds the area's known costumed criminals ("super-villains"), the majority of whom are captured and sent here by the GCPD after assistance by the Dynamic Duo.
Not much is known about the history of the facility. In the Sixties, it is run by Warden Crichton, whose practices in the prison seem quite odd. He has allowed some of the inmates to wear their costumes in cells, which may be a reason for the high level of escapes. He also allows the inmates to play sports. (The Joker once escaped during one game.) On some occasions, security has bordered on lax; Dr. Cassandra once lead a huge escape, freeing the Joker, Penguin, Riddler, Catwoman, King Tut, and Egghead.

- In modern comics, Gotham City holds criminals in Blackgate Prison. Arkham Asylum for the criminally insane was not created until 1974.
